The Non-resident Landlords Scheme affects withholding on UK rent; it does not settle your final UK tax liability or residence status. Keep agent statements and tax certificates. Approval to receive rent without deductions is not an exemption from reporting or paying tax.
The scheme and tax residence are different tests
HMRC's guidance treats a landlord living abroad for six months or more a year as a non-resident landlord for the scheme, even where the person is UK resident for tax purposes. Your residence status needs its own assessment; do not infer it solely from a flight itinerary or overseas address.
Supply travel dates, living arrangements and other relevant facts if residence needs reviewing. Double tax agreements and entitlement to allowances can also matter.
Tax may be withheld before you receive rent
Letting agents, and in some cases tenants, must operate the scheme unless HMRC has authorised payment without deduction. Ask for statements and tax certificates showing rent, deductible costs used in the withholding calculation and tax paid over.
For example, an agent's net transfer can already reflect management charges and withheld tax. Recording only that deposit as rent can lose both the gross income and a credit for tax already deducted.
Gross-payment approval is not an exemption
Permission to receive rental income without deduction does not mean there is no UK tax to pay. The annual reporting and payment position still needs checking. The scheme's quarterly withholding calculation is not necessarily the final calculation of your rental profit or liability.
Confirm the filing route and service scope
Non-residence can require supplementary information and suitable filing software. If you are also within MTD, the software and agent arrangements must support the actual circumstances; do not assume an ordinary resident-landlord process is sufficient.
Ask TaxSimba to confirm acceptance and scope before purchasing support for a non-resident case. Provide ownership details, rental statements, withholding certificates and relevant foreign tax information. A clear review at the start helps distinguish the UK rental return from any residence, treaty or overseas filing advice needing separate specialist work.
Check the home nation used for your tax calculation
Tell the accountant whether you live in England, Scotland, Wales or Northern Ireland, and about any moves during the tax year. Scottish rates differ for wages, pensions and most other taxable income; savings and dividends use UK rules. Welsh rates are set separately. Use the rules for the relevant year and your actual taxpayer status.
See Scottish Income Tax and Welsh Income Tax. These differences do not make a London address or an England-only earnings example appropriate for everyone.
Check the temporary MTD exemption before buying
Non-resident cases can fall within HMRC’s temporary 2026/27 SA109 exemption. Whether it is automatic or requires an application depends on the return history and expected pages. Check the exemption guide before choosing MTD support.
Reconcile rent before and after withholding
Illustrative preparation example.
Ask for agent statements and tax certificates showing gross rent, fees and any withholding. Keep permission for gross payment if held. The net transfer cannot show whether tax was withheld, while gross-payment approval does not settle the final annual liability.
Check: Which tax has already been paid and what reporting remains?
| Check | Practical action |
|---|---|
| What does the agent withhold? | Reconcile gross income, expenses and tax deducted using statements and certificates. |
| What is the actual residence position? | Provide the relevant facts; scheme status and statutory tax residence are not identical tests. |
| Is specialist filing support agreed? | Confirm supplementary information, software, treaty or overseas advice scope before purchase. |
Does permission to receive gross rent mean no UK tax?
No. It concerns withholding. The annual reporting and liability still need checking.
Can I use only the bank payout for the return?
No. It may already exclude fees and tax credits. Supply the full gross-to-net evidence.
